By purchasing a ticket or submitting a free entry, you confirm that you are aged 18 or over, that you have read and understood these Terms in full, and that you agree to be bound by them. If you do not agree to these Terms, you must not enter the Lottery.
Part 1 — Definitions
“Promoter” — Kingston Churches Action on Homelessness (KCAH), a registered charity in England and Wales.
“Lottery” — The KCAH Community Raffle, a small society lottery conducted in accordance with the Gambling Act 2005 and these Terms.
“Draw” — The monthly random selection of winning ticket numbers.
“Ticket” — A numbered entry into a specified Draw, purchased via the Payment Platform or obtained via the Free Entry Route.
“Single Entry” — A one-off purchase of one Ticket valid for one nominated Draw.
“Subscription” — A recurring monthly payment arrangement whereby one Ticket is automatically entered into each Draw for as long as the subscription remains active.
“Payment Platform” — Stripe, Inc., the third-party payment processor used to facilitate Ticket purchases.
“Ticket Price” — £5.00 (five pounds sterling) per Ticket, per Draw.
“Participant” — Any individual who has validly entered the Lottery whether by purchase or Free Entry Route.
“Working Day” — Any day other than a Saturday, Sunday, or public holiday in England and Wales.
Part 2 — The Promoter
2.1 The Lottery is promoted by Kingston Churches Action on Homelessness (KCAH), charity registration number [1075890], whose registered address is [KCAH, St Peters Church Hall, London Road, Kingston upon Thames, KT2 6QL].
2.2 The Lottery is registered as a Small Society Lottery under Part 11 of the Gambling Act 2005 with [Royal Borough of Kingston upon Thames]. Participants may verify this registration by contacting the relevant local authority. Registration number: 23/01365/GSSLR
2.3 The Lottery is conducted in compliance with the Gambling Act 2005, the Gambling Act 2005 (Operating Licence Conditions) Regulations 2007, the Lotteries Council Code of Practice, and all applicable guidance issued by the Gambling Commission.

Part 3 — Eligibility
3.1 To enter the Lottery, a Participant must:
(a) be aged 18 years or over at the time of entry;
(b) be a resident of Great Britain (England, Scotland, or Wales) at the time of entry;
(c) not be an employee, officer, trustee, or volunteer of KCAH;
(d) not be a member of the immediate family or household of any person described in clause 3.1(c);
(e) not be an agent of the Promoter or a person engaged in the administration or conduct of the Lottery.
3.2 For the purposes of clause 3.1(d), “immediate family” means a spouse, civil partner, parent, child, sibling, or cohabiting partner.
3.3 The Promoter reserves the right to verify eligibility at any time and to disqualify any Participant who does not meet the eligibility criteria, including after a prize has been awarded. In the event of disqualification, any prize awarded will be forfeited and the Promoter may conduct a redraw at its discretion.
3.4 By entering the Lottery, Participants confirm they meet all eligibility criteria and consent to verification checks if requested by the Promoter.
3.5 It is an offence under section 46 of the Gambling Act 2005 to invite, cause, or permit a person under the age of 18 to participate in a lottery. The Promoter takes this obligation seriously and may request proof of age at any time.
Part 4 — How to Enter
4.1 Paid entry — Single Entry. A Participant may purchase one or more individual Tickets at the Ticket Price of £5.00 per Ticket via the Payment Platform at [kcah.org.uk/raffle/]. Each Ticket is valid for one specified Draw only.
4.2 Paid entry — Monthly Subscription. A Participant may establish a monthly Subscription at £5.00 per month via the Payment Platform. Upon each successful monthly payment, one Ticket will be automatically entered into the corresponding Draw. Subscriptions remain active until cancelled in accordance with clause 8.
4.3 Free Entry Route. No purchase is necessary to enter the Lottery. Any person who meets the eligibility criteria in clause 3 may obtain a free entry by sending a written request to: [KCAH, St Peter’s Church Hall, London Road, Kingston upon Thames, KT2 6QL]. The request must include the Participant’s full name, full postal address, and the specific Draw month they wish to enter. Free entry requests must be received no later than the [25th] day of the month preceding the relevant Draw. Free entry requests submitted by email or electronically will not be accepted. The Promoter will not acknowledge receipt of postal entries and accepts no responsibility for entries lost in transit.
4.4 Each Ticket, however obtained, will be assigned a unique ticket number communicated to the Participant by email following purchase or upon confirmation of a free entry.
4.5 The Promoter reserves the right to refuse entry at its absolute discretion, including where it suspects fraud, misrepresentation, or breach of these Terms.
4.6 Tickets are personal to the Participant and may not be transferred, sold, or assigned to any third party.
4.7 No Participant may hold more than [5] Tickets per Draw. Entries in excess of this limit will be void and any payment refunded.
Part 5 — Ticket Price and Payment
5.1 The Ticket Price is £5.00 per Ticket. All prices are stated in pounds sterling and are inclusive of any applicable taxes.
5.2 Payment is processed exclusively via the Payment Platform (Stripe). The Promoter does not handle or store payment card data directly. All payment processing is subject to Stripe’s own terms of service and privacy policy.
5.3 For Subscription entries, payment of £5.00 will be taken automatically on or around the day of each calendar month that the subscriber’s subscription began. The Promoter accepts no liability for charges arising from currency conversion, bank fees, or failed payment attempts.
5.4 All Ticket purchases are non-refundable once payment has been processed, except:
(a) where a Draw is cancelled by the Promoter in accordance with clause 11, in which case a full refund of the Ticket Price will be issued; or
(b) as required by applicable consumer protection legislation.
5.5 In the event of a failed Subscription payment, the Participant will not be entered into the Draw for the month in which payment failed. The Promoter accepts no liability for missed entries resulting from payment failure.
5.6 The Promoter reserves the right to vary the Ticket Price on no less than 30 days’ written notice to existing Subscription holders. Participants may cancel without penalty if they do not wish to continue at the revised price.
Part 6 — The Draw
6.1 Draws are conducted monthly. The entry period for each Draw closes at 23:59 GMT/BST on the [25th] day of that month (“the Closing Date”). Entries received after the Closing Date will be entered into the following month’s Draw.
6.2 The Draw will be conducted on or before the [28th] Working Day of the month following the Closing Date.
6.3 The Draw will be conducted by a randomised electronic selection process, overseen by [Paul Seymour, Communications and Marketing Manager at KCAH], who will verify that the selection was conducted fairly and in accordance with these Terms.
6.4 The Promoter will maintain a complete record of all Tickets entered into each Draw, available to the relevant local authority upon request.
6.5 The Draw result is final and binding. No correspondence will be entered into regarding the outcome of any Draw.
6.6 In the event that a winning Ticket is subsequently found to have been obtained in breach of these Terms, the prize will be forfeited and reallocated at the Promoter’s discretion.
Part 7 — Prizes
7.1 The prizes available in each Draw will be published on [kcah.org.uk and Instagram, facebook, bluesky and linkedin] prior to the Closing Date of that Draw.
7.2 The total prize fund for each Draw shall not exceed 80% of the proceeds from Ticket sales for that Draw, in accordance with the requirements applicable to small society lotteries.
7.3 Cash prizes will be paid by bank transfer to the account nominated by the winner within [14] Working Days of the Draw.
7.4 Non-cash prizes will be delivered or made available for collection within [28] days of the Draw.
7.5 Prizes are non-transferable and non-exchangeable. No cash alternative will be offered in lieu of a non-cash prize, except at the Promoter’s sole discretion.
7.6 The Promoter reserves the right to substitute any prize with an alternative of equal or greater monetary value where the advertised prize becomes unavailable for reasons outside its control.
7.7 Prizes are awarded subject to the winner providing any information reasonably requested by the Promoter, including proof of identity and bank account details for cash prizes.
7.8 The Promoter accepts no responsibility for any tax liability that may arise for a winner as a result of receiving a prize. Winners are solely responsible for any tax obligations arising from their prize.
Part 8 — Winner Notification
8.1 Winners will be notified by email within [5] Working Days of the Draw date.
8.2 The Promoter will make [3] reasonable attempts to contact a winner. If a winner cannot be contacted or fails to respond within [28] days of the first notification attempt, the prize will be forfeited and the Promoter reserves the right to conduct a redraw.
8.3 The Promoter accepts no liability for notification emails that are undelivered, filtered as spam, or not received for any reason.
8.4 Winners’ first names and counties of residence will be published on [kcah.org.uk] following each Draw, unless a winner objects in writing within 7 days of notification.
Part 9 — Subscription Cancellation and Refunds
9.1 A Subscription may be cancelled at any time by emailing [paul.s@kcah.org.uk].
9.2 To avoid being charged for the following month, cancellation must be received no later than [48 hours] before the next scheduled payment date.
9.3 Payments already processed at the time of cancellation are non-refundable subject to clause 5.4.
9.4 Following cancellation, the Participant’s Ticket for any Draw for which payment has already been received will remain valid.
9.5 The Promoter reserves the right to cancel a Subscription with immediate effect where it reasonably believes a Participant has breached these Terms or where fraudulent activity is suspected.
9.6 In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, Participants who purchase a Subscription online have the right to cancel within 14 days of the initial subscription date without giving a reason, provided no Draw has taken place during that period.
Part 10 — Use of Proceeds
10.1 The Lottery is conducted for the benefit of KCAH’s charitable purposes, namely the relief of homelessness and the support of people experiencing homelessness in and around Kingston upon Thames.
10.2 All proceeds, after the deduction of legitimate expenses and prize costs, will be applied exclusively to KCAH’s charitable purposes.
10.3 In accordance with the Gambling Act 2005, the Promoter confirms that:
(a) the aggregate of prize values in any single Draw will not exceed £25,000;
(b) the aggregate of all Lottery proceeds in any 12-month period will not exceed £250,000;
(c) no single prize will exceed £25,000 in value;
(d) no rollover of prizes between Draws will take place unless expressly permitted under applicable legislation.
10.4 The Promoter will submit returns to the relevant local authority following each Draw as required under the Gambling Act 2005.
Part 11 — Cancellation and Suspension
11.1 The Promoter reserves the right to cancel, suspend, or postpone any Draw or the Lottery as a whole, including in circumstances of technical failure, force majeure, insufficient ticket sales, or legal or regulatory requirement.
11.2 In the event of cancellation of a Draw, the Promoter will notify all affected Participants within 5 Working Days and will refund all Ticket Prices paid for that Draw within 14 Working Days.
11.3 The Promoter’s liability in the event of cancellation is limited to the refund of Ticket Prices paid.
Part 12 — Data Protection and Privacy
12.1 KCAH is the data controller for all personal data collected in connection with the Lottery. KCAH is registered with the Information Commissioner’s Office (ICO), registration number [Z6627160].
12.2 Personal data collected during entry will be processed for: (a) administration and conduct of the Lottery; (b) compliance with legal and regulatory obligations; (c) prevention and detection of fraud; and (d) where consent has been separately obtained, communication of news and fundraising information from KCAH.
12.3 The legal basis for processing under (a), (b), and (c) is performance of a contract and compliance with a legal obligation under Article 6(1)(b) and (c) of the UK GDPR. The legal basis for (d) is consent under Article 6(1)(a).
12.4 Personal data will be retained for [7 years] following the conclusion of the relevant Draw.
12.5 Personal data will not be sold or shared with third parties except with Stripe for payment processing, with the relevant local authority as required by law, or where required by a court order.
12.6 Participants have the right to access, rectify, erase, restrict, or object to the processing of their personal data. Requests should be directed to [paul.s@kcah.org.uk].
12.7 Participants who believe their data has been processed unlawfully may lodge a complaint with the ICO at ico.org.uk.

Part 13 — Responsible Gambling
13.1 KCAH is committed to the promotion of responsible gambling. If you are concerned about your gambling or that of someone you know, free confidential support is available from:

13.2 The Promoter reserves the right to refuse entry to any person who, in the Promoter’s reasonable judgement, is gambling beyond their means or is otherwise vulnerable.
Part 14 — Fraud and Abuse
14.1 The Promoter reserves the right to disqualify any Participant and void any entry where it reasonably suspects fraudulent entry or payment, use of automated or bulk entry methods, tampering with the entry or draw process, or any breach of these Terms.
14.2 The Promoter reserves the right to report suspected fraudulent activity to the relevant authorities, including the police and the Gambling Commission.
14.3 Any attempt to manipulate or interfere with the Lottery may constitute a criminal offence under the Gambling Act 2005 and the Fraud Act 2006.
Part 15 — Limitation of Liability
15.1 To the fullest extent permitted by law, the Promoter’s total liability to any Participant shall not exceed the Ticket Price paid by that Participant for the relevant Draw.
15.2 The Promoter shall not be liable for any failure caused by circumstances beyond its reasonable control, technical failures of the Payment Platform, loss arising from inaccurate information provided by the winner, or any indirect or consequential loss.
15.3 Nothing in these Terms shall exclude or limit the Promoter’s liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
15.4 Nothing in these Terms affects Participants’ statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.
Part 16 — Intellectual Property
16.1 All intellectual property rights in the Lottery, including the KCAH name, logo, and promotional materials, are owned by or licensed to KCAH.
16.2 By entering the Lottery, Participants grant KCAH a non-exclusive, royalty-free licence to use their first name and county of residence for the purpose of announcing Draw results in accordance with clause 8.4.
Part 17 — Complaints
17.1 Any complaint regarding the conduct of the Lottery must be submitted in writing to [KCAH, St Peter’s Church Hall, London Road, Kingston upon Thames, KT2 6QL] within [28] days of the relevant Draw.
17.2 The Promoter will acknowledge receipt within 5 Working Days and provide a substantive response within 28 Working Days.
17.3 If a Participant is not satisfied with the response, they may refer their complaint to the relevant local authority or to the Gambling Commission at www.gamblingcommission.gov.uk.
Part 18 — Amendments
18.1 The Promoter reserves the right to amend these Terms at any time. Material changes will be notified to active Subscription holders by email no less than 14 days before taking effect.
18.2 The current version of these Terms will always be available at [kcah.org.uk/raffle-terms-and-conditions]. The version number and effective date at the top of this document indicate which version applies to any given Draw.
Part 19 — General
19.1 Entire agreement. These Terms constitute the entire agreement between the Promoter and each Participant in relation to the Lottery and supersede all prior representations, negotiations, and understandings.
19.2 Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.
19.3 Waiver. A failure by the Promoter to enforce any provision of these Terms shall not constitute a waiver of the Promoter’s right to enforce that provision at a later time.
19.4 Third party rights. These Terms do not confer any rights on third parties under the Contracts (Rights of Third Parties) Act 1999.
19.5 Governing law and jurisdiction. These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
19.6 Regulatory framework. The Lottery is conducted pursuant to the Gambling Act 2005 and all applicable secondary legislation. In the event of any conflict between these Terms and applicable law or regulation, the applicable law or regulation shall prevail.
19.7 Language. These Terms are drafted in English. In the event of any translation, the English language version shall prevail.
